It's been such a long time since I've had these botherations, but I had to do a UIC on a buyer after friendly reminders for payment sent and no response. Directly after he got the UIC he writes and asks me to cancel the claim because he no longer wants the item. I told him I couldn't, that I can't end the claim for four days because he hadn't paid yet, nor could I cancel the order because there was a claim in effect. So tonight, he pays me, but in his words, so he doesn't get a strike against him and asks me to refund because again, he no longer wants it. Grrr! So my question is, if I refund will I get my fees back? Or would it be better for me, if I just asked him to cancel the order, rather than me do it. I'm not sure how this will work since he paid. I'll be refunding regardless. I just want to sort the best way to get my fees back.

And ... if I simply refund, he will still be the buyer. I won't be able to resell it for what, 60 days or something. I think I need to ask him to put in a request to cancel. I don't think I should do that myself, should I?

The Only way now to get your fees back is to do a cancellation request & hope the customer responds affirmatively, or that your customer does nothing and the cancellation will go through in eight days. When You start cancellation request eBay in conjunction with Paypal will refund your customer from you account immediately without you having to do anything further. Be sure to choose the Customer asked to cancel for your reason.

Thank you decal-fx, but can I cancel though, even after I went the claim route? I'm not sure I can now.?
All this said, the fees aren't my main concern. I could just refund him and be done with it, but I won't actually be done with it. He will continue to be the buyer on paper, holding my item hostage until it fades into the netherworld.

I know that if the buyer hadn't paid and you opened an unpaid item claim you wouldn't be able to change to a cancellation but perhaps the fact that he has paid will make a difference. You should try to do a cancellation. If it allows you to do it now then I believe it refunds the buyer the same time as the cancellation.
If you just refund the buyer and do not do any sort of cancellation there is a chance that you will get a seller cancellation defect. You could probably get it reversed because the buyer did ask to cancel the item but if you can do the cancellation now that would be the easiest route.
Edit...I just noticed that you already said that you were going to try to do that. Please let us know if it worked.

I tried last night and again this AM and this is what I'm getting.
We weren't able to cancel your order You can't cancel this order right now because there's a case open for it.
He paid last night, 24 hours before the 4th day when he'd get a strike against him. I wonder if the program is still waiting for the end of those 4 days?
I may have to call eBay.

And now I've tried a different route and got this message.

You are going to have to phone ebay on this one. They can do it on their end. Make sure ebay is aware of how bad this buyer is.

I did. I just got off the phone with Luigi in Inda (assumption) and at his request, refunded while I had him on the phone. He returned fees and cancelled with no deficit at my end. He also suggested I report the buyer which I did.
Buyer has 25K feedbacks so I doubt this is the first time he's done this. Now to block him ... paying to avoid strike and then asking for refund. Strike avoidence?? lol
I have no problem refunding, but it's not that simple when you have to consider feedback, fees, deficites and items held hostage with the inability to do second chance offers.
Also, and I kinda thought so, you can't do cancellations even when a claim is closed. It's one or the other. Not both.

This is another shining example of how the rules allow buyers to walk all over sellers and we are just left to their mercy.

So true. And he was so casual about it all. No biggy to him. But a lot of work and time for me to sort it out. I doubt I'll even get a thank-you.
The other thing is ... it doesn't appear to be cancelled. And he can still leave feedback. I may have to call eBay back. More drain on my time.
