I purchased item two side mirrors and the buyers item took a month and a week to reach me, then when i opened they were badly broken, so what you do with broken glass(because it is unsafe) throw in the garbage. I send an email to the buyer requesting what to do. He replied so late that the garbage was picked up and items were gone to dump. Then he kept me in loop and asked to take a picture, which is not mentioned on his site that if the item received is broken damaged a picture is a must. But anyway I tried to explain and nothing keep asking for picture. Which he knew is not possible as i had thrown it in garbage.
My frustration is that while all this time I was trying to figure out how to get my money back or replacement, the time limit to leave a feed back is gone. I can't warn other customer about this problem and leave a negative feed back. I think E-bay can do much better than this.

The problem is that you use wrong wordings of buyer when it should be "seller" and another problem is that you didn't open a dispute as Never received within 45 days. Had you open this dispute, the funds he received from you would put on hold until you escalate to eBay/PayPal.
Never wait until you received any item pass after 45 days. Open the dispute on the 30th or a little furthre before 45th day (I prefer on the 40th day). Don't wait too long next time.
As for fragile items, I would think it should include a tracking number? Unless it comes from international countries. What is the item # so we can see which sellers to avoid.

You should have filed a not as described claim but even if you had, you might have lost it. The seller is perfectly within their right to want to see a picture of a damaged item as some sort of proof so you should have kept the pieces in a safe place until the claim was settled. Otherwise, anyone could say that an item was received damaged but...oops...I can't prove it because its in the garbage.

I'm not sure why a fragile item be more likely to have a tracking number than any other item or what good a tracking number would do in a snad situation.
As far as the buyer providing an item number...do you know that the seller is at fault here? Do you refund any buyer that tells you the item they received got damaged in the mail and not ask for any proof?

Or you could leave the broken item in the packaging, put it out of reach of the children and contact the buyer.
You were too hasty leaving the seller and eBay/Paypal unable to help you.
The seller was apparently happy to refund based on a picture, which tends to mean he was willing to work with you. But you tossed the evidence before he even knew there was a problem.
Take responsibility for your own hasty actions.
