Seller not refund and has been 2 months now. 

His account locked ???

Time for an Item Not Received Dispute.

You can open this on eBay (the Resolution Centre is at the bottom of this page) for 30 days after the estimated delivery date.

If the date is, say March 31 to April 10, then you can open an eBay Dispute until May 25.

 

Now.

It looks like you did this.

The seller asked for another week for delivery.

Is this okay?

If you do not agree, you have to say so in the Dispute.

And ask for your money back.

If the account is 'locked'... hmm do you mean he is Not A Registered User?

Say so in the Dispute, that will get your money refunded tout suite.

NARU means the member has been kicked off eBay.

 

If the seller cannot prove Delivery (not shipping, delivery) and I notice no tracking number was given in that message, then he will be forced to refund. If he doesn't do it promptly, eBay will, and go after him for their money. And they have his credit card and bank information.

 

You are also backed by Paypal and, if your PP account is backed by one, by your credit card.

Uh-oh

 

Well the seller is in China and has 128 negs in the past year (and 7682 positives).

98.3 % is not great, but not horrible.

 

But then there was this in a Response from an unhappy buyer

    seller agreed to resent item, only if i change badfeedback, awaiting revise mail

That's a classic scam by a seller who knows that once a Dispute has been closed it cannot be reopened.

You do not say why you require a refund nor what you mean by the seller's account being "locked" (Not a Registered User?)

 

Not that it matters, if you are genuinely entitled to a refund you will be able to pursue it through ebay or paypal.

On ebay, you have 30 days after the last estimated date of delivery to start a claim.

Is there still time or has that passed?

If this date has passed, paypal gives you 180 days from when you paid to file a claim.  See Section 13.5 of the following, and there is a link to the Resolution Center you can use:

If the seller is no longer registered, mention this in your claim as it will speed up your refund.  I am assuming this is about an item which did not show up.  They can take a long time coming from China, but 2 months is plenty of time to wait.  File an appropriate claim and get your money back.
