Seller sent me an item that was 1. wrong size 2. USED when it said it was new. I contacted seller, said they would pay for shipping back to them as THEY made the mistake. I waited - and waited - NO refund and NO shipping sent to me so I filed a PAYPAL DISPUTE-Claim. Seller did not respond in any way. PAYPAL went in my favour and returned money to me.
TODAY the seller is now disputing and wants me to mail item back -
I called PAYPAL, they said Seller cannot get anything from me.
Sent me an email:
Thank you for contacting PayPal.
The case was already closed in your favor due to no seller response on December 19, 2013. The decision is final and can't be changed.
They told me I do not have to do ANYTHING, but the file looks like it is still OPEN???
What on earth is happening?
Anyone else have this experience?

How does the file look as though it's still open?
Keep in mind that the date that was given in your email from PayPal is today's date. Perhaps your claim information just needs to "click over".

The appeal is based on Paypal's normal policy that disputed items must be returned at the buyer's expense for a refund?
As a seller, I have some sympathy for the seller,

who I suggest expected to have the item returned before refunding, at which time, he could see the cost of reshipment and refund that.
Sounds like mis-communication to me.
But ignoring the PP dispute was dumb.

In the extremely unlikely event of the seller winning an appeal there is no way for PP to 'unrefund' your refund.

it's pretty standard to return the item before getting the refund. never heard of any merchant doing it the other way. even costco with their crazy return friendly policies needs the stuff back, otherwise anyone could just say "wrong size, not new, gimme the money back".
policy for not as described disputes is to send it back and unlike automatic dispute resolutions, paypal appeals are strictly following policies. my bet is on OP having to send it back.

Update on the story
Case is closed -
Seller did NOT get the item back.
The shipping back would have taken almost as much as the item cost. (Heavy item)
Paypal said I do not have to mail it back, as it was her error, AND she did not reply to PP.
I am stuck with an item I do not want and I bought items to MATCH this(before I found it was the wrong size) - so I am stuck with these - so I AM STILL OUT OF POCKET.
OH WELL.
The thing I learned was READ ALL NEG/Neutral FEEDBACK - BEFORE buying. (The seller had feedbacks that said - "Sent WRONG ITEM - Promised to pay for return shipping -BUT DID NOT SEND THE MONEY".
It is pretty clear this seller is a ROTTEN SELLER.
As a buyer - I should not have to pay for a SELLER's "mistake"- otherwise - what is to stop BAD sellers from mailing out all sorts of JUNK? and expecting Buyers to just suck it up?
I am Glad that MOST SELLERS are REPUTABLE.
I now consider this Story and Thread closed.
