Help with determining where I stand. dispute over return shipping charges results in full refund

Hi everyone.

I will try to sum this up in bullet points to keep it as short as possible.

 

1. I'm in Canada, Seller in US.

2. Ships me wrong product and I request refund.

3. Seller accepts and initiates return process.  Then claims he cant create a shipping label. Asks me to ship to him, and let him know how much and he will add it to my full refund.

4. I refuse that. He should be providing label. It was his mistake initially and my paying out of pocket ahead of time doesn't protect me.

5. I offer to get shipping quote from post office here and he is to send me funds ahead of time, but NOT to do a partial refund as that doesn't protect me.

6. He agrees. I provide quote, he processes partial refund "to cover shipping".

7.  I express my concerns over this AGAIN. He says "you'll get your funds, just send me my merchendise please"

8. I tell him AGAIN I'm not comfortable with that. I tell him to provide a shipping label or I will dispute with Ebay Buyer Protection.

9. He issues full refund without me prompting.

10.  Won't respond to me now.

 

So I still have the merchandise.  I have no shipping label.  I am still out of pocket for my original shipping and duty I paid.   He wont respond to me.

 

All I want to know is where I stand with shipping back the product?   If he wants me to keep it as compensation I'm fine with that because I'm tired of dealing with this.

 

If I don't ship it back to him, am I going to have me refund taken back from me?

and to add to this, when I requested the shipping label for the last time, i provided him a link to an ebay forum thread that tells sellers in the USA how to obtain canadapost shipping labels.

 

so i did that leg work for him also.

At this point you are not required to return the item unless he sends you a return shipping label.

 

However, you said you were out original shipping and duty. Was the duty paid through ebay when you made the purchase or was it paid when you received the parcel?  If it was the latter, you can apply to get your tax and duty back but only if you can show proof that the item was returned. If the seller used the gsp to ship the item and you prepaid import fees then you are supposed to get that back from the gsp (not the seller) but you would probably have to talk to customer service about that now.

Was the purchase through the GSP?

If so you may be able to switch over from the seller to the GSP specialist.

GSP has been much more forgiving about claims, particularly if it is a damage in transit claim.

 

If not, it is probably time to ask eBay to step in and Escalate to a Claim.

Note your attempts to get the seller to pay for a shipping label.

Yes the duty was paid ahead of time during the initial purchase.

Thankyou for the advice. We will contact customer service for that duty and shipping charges!

Be specific that this is a GSP shipment.

Don't take it for granted that the rep knows anything-- including that Canada is an independent nation with its own postal service.
