Not getting my refund for item damaged , destroyed and sent back to seller .

Didn't receive item ordered on June 1 , ebay told me it was delivered and closed the case on me !! The seller sent me " shipping history"  that shows item was destroyed, visible damage and undeliverable June 17 ,and also ,that item was sent back to seller . I spoke with Gemma at ebay customer service , told her about shipping history , once she saw evidence of shipping history she affirmed I was good for a refund . Well 10 days later , no sign of refund , seems like they forgot about me ! What more evidence do they need ?? Item was damaged and destroyed in there shipping department , and according to them, it was sent back to seller , So, me the buyer, is short $401.86  . I WANT my REFUND !!!

Gemma was on the phone?
She doesn't work for eBay. She works for a call centre sub-contracted by eBay.
