What usually happens when a seller is kicked off eBay (or a listing is deemed unacceptable) is that the buyer is told by eBay that the paid item may arrive and the buyer should not do anything until the last estimated date for arrival has passed.
And in some cases, the seller did something stupid, but not illegal, and the item has in fact been sent and does in fact arrive.
All is well.
But.
More often eBay was dead right in kicking the scammer to the curb.
The item never arrives.
And,
Now that eBay and Paypal are not the same company anymore, eBay has little control over how PP runs its business.
PPs Buyer Protection as a first step is a Hold on your payment to the seller for up to 21 days (shorter if the seller is US based).
All of which is background.
Take a deep breath.
Go to your Paypal account.
Copy the transaction number for the bad purchase.
The PP Resolution Centre is at the top of you PP account page under Tools.
Open an Item Not Received Dispute.
The first suggestion is to Contact the Seller.
Don't bother. You don't have your purchase and eBay has dumped him.
In the Dispute state that the seller is Not A Registered User (NARU). This will speed things along.
Ask PP to step in and escalate to a Claim.
If the seller cannot prove delivery (not shipping, delivery) you will be refunded.
Promptly.
Umm. If you back your PP account with a credit card, the refund goes to the card not the account. So check there too.
Normally if the dispute is between a buyer and seller who have different opinions about the transaction (to put it mildly) you would be able to Dispute through eBay, but eBay in an all too common rush to judgement, makes that impossible when the scammer's eBay account is closed.
Never put down to conspiracy what can be explained by stupidity. And eBay has their sign.

I did all this, its now April 6th, almost a month since I chose to use Ebay. I received an email from Ebay saying I have been refunded but for almost a week it still sits in "pending" status. I spoke with customer service last night ( 3 days trying to get to customer service by the way the "call me back" option is great if you actually call me) they tell me it will be a few more days yet. At this point all I can do is wait, once refund is received however I will be deleting my Ebay account , its only open right now so I can complete this refund. I will never be using Ebay again, way too many better options for a consumer available today. Ebay is nothing more then a bunch of people posing as sellers from various countries but everything comes from China anyway. It used to be good but those days are gone as I now have witnessed. I wish Ebay and all other buyers good luck, my life however will be less stressful without Ebay in it and who doesnt want to live with less stress. Word of advice, streamline your refund policies when involving a clear resolution theres no need for the extended wait when both the buyer and Rbay know the package wont be arriving.

Did you back your PP account with a credit card?
This is usually a good idea, but not everyone does it
If you did, check there for the refund. Credit card payments are returned to your credit card balance.
