Seller found a way to presell items and nothing is being done about it

There is a seller on ebay which presells diecast aircraft models. As far as I know you are only allowed to sell items which have a guaranteed delivery date of 30 days. His listings consist of models that Inflight 200 has simply announced and has not released yet and will not be releasing them for months at a time. In my case the model I purchased on December 2 2019 has still not been released. The time has come and gone and I cannot make a claim against him through ebay or through paypal. This guy has found a loophole and no one seems to be doing anything about it. I have reported him twice and I am rounding up people to do the same. He posts a delivery date that is within the allowed 30 days but then keeps changing the date in the listing to the point where the buyer can no longer make a claim against him. I was told to report all his preorder listings and I did so why are they still up???? what is ebay not seeing here???

Once you purchase a item the seller cannot change the estimated delivery date so you always can file an item not received claim for up to 30 days after the delivery date that was on the listing the day you made the purchase.  That delivery date should show up on your purchase history and shouldn’t change.   If you are looking at the listing itself (rather than your purchase history) that date will change each day as that delivery date is based on if you purchased the item today. 

if you paid with PayPal you have 180 days from the date of purchase to file a claim.  If you paid with a credit card you can contact them to start a chargeback.
