if the item Never shows up . how do I prove to ebay I did not get it .
Signature Conformation never sigh it or nothing proving I got it
seller is scamming probably been 2weeks should of came 5 days ago

You don't.
The SELLER has to prove that you did.
Go to the Resolution Centre at the bottom of this page.
Open an Item Not Received dispute.
If you have already contacted the seller, you can skip that suggestion.
Ask eBay to step in and escalate to a Claim.
If the Seller cannot prove Delivery (not shipping, delivery) you will be refunded.
Now.
Do not accept an offer of a replacement. That's a scam.
Do not close the Dispute until you have the refund. That's a scam too.
Keep an eye on the calendar and don't let any deadlines pass.

Is this the same item you say in another post shows that it is Delivered?
If so, you have some detective work.
If the item was Signature Required, it is valued over $650, right?
Ask your housemates if they have seen the parcel.
It may have been carefully put where it couldn't possibly get lost.
Ask the neighbours if it was given to them in error.
They may have been meaning to pass it on, but stuff happens.
Look inside any boxes, BBQs or rarely used storm doors in case the carrier left it there.
Go to the postal outlet.
Ask if it is there.
Bring the tracking number, it will help the clerk.
You will also need ID.
Go to the Post Office.
Tell the postmaster about the disappearance. She needs to know if Signature Required shipments are not being correctly handled.
Go to the police.
Again you will need your paperwork.
You want a police report number if only for your household insurance claim.
This should also be given to the PostMaster.

I did not do anything never got it . but tracking says delivered but the phone never came
. will I still win the case if he use that tracking number . he could say its delivered

If tracking shows it was Delivered and you say you don't have it, you need to search for it or at least examine the details of tracking to determine whether you have been given the correct tracking number for your item.
Tracking that shows Delivered when it is, in fact, nowhere to be found, presents for you a problem. You can try to take it up with ebay but it's not the fault of the seller if the carrier made a mistake. You will have to speak to the carrier, and ask the seller to speak to the carrier, about a possible delivery scan error. After that, action begins. A ticket is opened and an investigation launched.

If the item was only $250 including postage, then the Seller only needs to show Delivery to win an Item Not Received dispute.
While the Seller can add Signature Required to any tracked shipment, neither PP nor eBay require this in a Dispute under $650Cdn including postage.
You can change an Item Not Received dispute to a Not As Described dispute. EBay will insist that the seller pay return postage, but Paypal makes return postage the responsibility of the buyer*.
*It's a tradeoff for the much longer Dispute period.

There is a lot to be said for using Signature Confirmation on any shipment the seller is uncomfortable with.
For $1.50, the seller is politely telling the buyer either that she thinks he will appreciate the extra security (which would have been helpful to the OP in this case) or that Big Brother has an eye on a the buyer if he was thinking of scamming.
Sorry, OP, this has to do with Seller problems and not with yours.
Have you checked with the housemates, neighbours, postal outlet, and the Post Office yet?
