So, I made a sale of a DVD last week. I marked the item as shipped (letter post) and an hour later the Buyer said he was not happy with the item, because he noticed a "scratch." He asked for a refund and he submitted a Charge Back through his financial institution. This was a domestic sale (Canada).
Now today, Ebay is charging me for the sale of the item (under $40). I am out: the DVD, shipping materials and now the amount of the DVD. How is this okay? For me it is: lose, lose, lose and the buyer win win and Ebay with a win (my money).

How long did he take to submit the chargeback? Did it happen almost right away? If so, you should definitely dispute it with eBay because chargebacks are not supposed to work like that. The buyer is supposed to open an eBay claim first (try to resolve it with the merchant). If that never happened and the timeframe was within the 30 days, I believe you should be able to get that reversed (but I'm not positive).

The buyer filed some sort of claim: "item not received." Then, the buyer closed it an hour or two later and did a chargeback through their financial institution. The chargeback came the same day as the claim.

Yeah, definitely dispute it with eBay. Do it through eBay for Business on Facebook. Make sure you specify that the buyer did not give you an opportunity to send a label and get the merchandise back through eBay's process, which is supposed to be a requirement for a chargeback to be filed.

Afaik therehas never been a requirement that a buyer file a claim with eBay first though that doesn't necessarily mean all is lost.
I'm a bit confused at the timeline as I got the impression from you that the decision has already been made. Normally when a buyer files a payment dispute/chargeback for an item not as described you have a few days to respond with 'evidence' if you want to dispute the chargeback. Or, you have the chance to refund in which case you would at least get your ebay fees back. Have you responded already and if so, has ebay already given you a decision?

@pjcdn2005 - I got some sort of a "Dispute Fee" back, after talking to an Agent. Thanks for the advice/feedback. But, I think I will leave the thread here as I have an unusually busy weekend (relative in town).

It's very simple, don't sell anything on eBay your not willing to just give away for free.
Any buyer can demand a refund for anything and if you don't give it to them they can chargeback and if you fight that you will likely have to spend an extra $20 fee fighting it.
Just issue the refund, cut your losses, then find ways to prevent this in the future.
It's basically the equivallent to retail theft. You will probably want to do what most retail stores do and just raise prices of everything a little bit to cover that loss.
