Bought laptop off eBay, seller not shipping since last Monday/not responding to messages

Hello there; I have purchased a Thinkpad T400 on the 22nd of May, 2017; although the seller doesn't seem to have shipped it yet, I am not getting any tracking number nor notification. I sent them a message asking when the package would be shipped to no response; and now I'm thinking that they will most likely not send anything... Should I open a dispute via eBay or PayPal? Thanks.

Didyou receive a notice from eBay giving you the last estimated day for delivery?

If so, you cannot open a Dispute until that date.

If you have not, and it seems unlikely if the seller has not marked the item as shipped and given you a tracking number, then go to the bottom of this page and open an Item Not Received dispute.

If the seller cannot prove delivery (not shipping, delivery) you will be refunded.

 

If eBay did give you a tracking number, seven days should get the item at least into Canada. Where does the tracking say it is?

Remember that tracking is a Seller Protection. You are protected by eBay and Paypal's Buyer Protection policies.

 

Here is a boilerplate I prepared about disputes. Some of it may not apply to you.

 


You have 30 days after that 'last estimated date for arrival' to open a Dispute with eBay's Resolution Centre, which is at the bottom of this page.
The first suggestion is to Contact the Seller. Don’t get into a conversation.
Just ask “When was this sent? What service was used? What is the tracking number?”
Don’t get into a conversation. You want either a prompt refund OR a tracking number that shows the purchase is in Canada.
Do NOT accept a replacement. It won’t arrive.
Do NOT close the Dispute until you have the product or the refund.
If you have already attempted to Contact the Seller,  skip that step, ask eBay to step in and Escalate to a Claim.
If the seller cannot prove Delivery (not shipping, delivery) you will be refunded.
 
If the 30 days have passed, go to your Paypal account.
You have 180 days from payment for this Dispute.
Find the transaction and copy the number.
The PP Resolution Centre is at the top of your PP account page under Tools
Same process basically, skip the Contact Seller and escalate to a Claim.
If the seller cannot prove Delivery (not shipping, delivery) you will be refunded.
 
In future, read the feedback.
Don't buy from sellers with less than 98% positive (99% for Asian sellers)
Read the negative feedback , including seller responses, for patterns like slow or no delivery, poor communication, low quality, counterfeits.

Paypal will often allow you to open an Item Not Received case sooner than ebay.

 

What was the seller's handling time? What Estimated Date of Delivery were you given?

 

Paypal Seller Protection is voided if a seller waits too long to mail something after they have been paid, to the best of my recollection. Check out the details of the transaction on your Paypal Account summary, it will tell you when you can open a case, and the last date by which you have to fix something wrong with the transaction.

The seller's handling time was 2 days, and the estimated date of delivery I was given was May 31 - June 7.

That's according to ebay, right? The seller in question has already received a defect on his or her account for failing to meet their handling time but that doesn't help you in your immediate predicament.

If you log into paypal and go to the Resolution Centre, select that case and then look to see when they tell you as a date that you can lodge a complaint with it. Opening a case via Paypal will likely get your seller's attention since Paypal is the keeper of the funds.

And this goes without saying.... do NOT close your case before you see a refund no matter wha the seller tells you and do NOT accept an offer of a replacement. It likely won't come either.
