Hello,
I opened a case for this already. (Item not as pictured and then seller said "Hello Dear friend I am sorry about that Could you please accept it Or we can give you a partial refund Sorry to bring you inconvenience Best regards") What do I do? Do I just take the partial refund? This seems unfair since I payed for something I didn't want. Do I wait until I can ask ebay to step in?

If you ask eBay to step in you will be required to return the item to China with Proof of Delivery.
Which will cost you about $40.
EBay may tell you that the seller must send you a Return Shipping Label.
This is impossible.
It would also be impossible if the seller was in the USA.
EBay does not understand this.
You would have to return the item on your own dime($40) and hope that the seller reimburses you for the return shipping. The average income in China is about $20 a day. So....
If you can't show that the item has been returned (on your $40) eBay will not force a refund from the seller.
So.
Is the partial worth the annoyance?
Can you give /donate/ dump the misdescribed item?
You can leave appropriate feedback. The most effective feedback is calm and factual. 'Misdescribed. Gave partial refund. Donated to charity" for example.
When you have a hammer, every problem looks like a nail.
