HELP NEEDED WITH LISTINGS REMOVED

Hi Everyone,

I'm a brand new Powerseller that has a question for you experienced Powersellers.

I've been selling designer merchandise for about a year now. Prior to becoming a Powerseller, I was selling the same merchandise from the same sources listing them in the same way and I never had my listings pulled.

I become a Powerseller, I list 12 pairs of jeans, my listings get pulled. Yes, it could be a coincidence but I still have no clue why they got pulled.

My jeans are bought from department store liquidations such as Bloomingdales or Macy's. They have the retail price tags on them and are completely authentic. Some of my jeans even come with paperwork. My listings do not contain any spam such as reference to movie stars names etc ... I do not use the trademarks photos, logos etc ... I use my own photos, I have a legal disclaimer that the particular brand is not affiliated with my auctions and is their own registered trademark. I do not use any writeups from any other Ebay sellers in my descriptions. I am so very careful not to infringe upon the trademarks or break any listing policies.

This particular lot of 12 was a mix - 7 For All Mankind, Joe's Jeans, Antik Denim and Diesel. All got pulled in the same day - explanation was trademark infringement - that the jeans are counterfeit - this was not a VERO pull but an Ebay pull. I emailed Ebay right away explaining where the jeans were obtained from and asking for an explanation as to why the listings were pulled and also asking if there was anything wrong with my wording so I know for future. It has been a week now and after 2 emails sent no response.

I have now had to list these jeans elsewhere as I do not dare try to relist them on Ebay as I do not want my account suspended.

I thought by becoming a Powerseller that our questions would be answered with some priority, or that a question would be answered period. I now feel scared to ever list another pair of jeans on Ebay again which is a real shame to me and to my customers. I have no idea what to do about this, can anyone offer me any help, any suggestions would be appreciated.

I sincerely only want to list on Ebay and would love to resolve this matter as Ebay is my full-time business and I take it and my status very seriously. Thank you all from Vancouver!:-)

Well I didn't know that you couldn't make reference to movie stars names, however I looked at just one of your auctions, #5442026543, and there actually are movie stars names referenced there. I have no idea if that was your problem though.

Good luck with that. Perhaps if it is a Diesel jeans you should remove reference to other name brands. Same as for the other name brands. Just have the name brand of the auction at hand.

I have also had auctions pulled lately but even though I don't agree with their reasoning, I understood them.

Hello:
I took a look at your ads to see if I could spot anything amiss. They seem fine to me except for the fact that your shipping is extremely high. The ads may have been pulled for "fee avoidance" though there are millions of sellers out there doing it on a far larger scale than you are.
Just a thought.

Someone probably complain about your jeans and they have to investigate the matter, so first they pull out your listings, then investigate.
You'll have to redo all your listings after that even though your in no fault.
Happened to me once, took 2 weeks (without the powerseller status) and all of the trouble to relist again. I even had 2 listings with 1 day left and 15 bids on them! Took a long time to have those buyers back again.

Yes, I have had experiences like that as well.

It's just bad luck I think...if you happen to get just the wrong person looking at your item, and if they can find even the tiniest thing wrong with it, they tell ebay and they pull it.

Then you have to re-list it again, using your own time and cost of fees. It's a total pain. I wish they'd let us know who "ratted" on us, so we could at least block them from bidding on our items.

Actually, I think none of these answers are the real reason for your problem.

It likely has to do with your listing of Gucci. If you research the history of Gucci items on ebay, you'll find they are quite litigious.

If you research the history of Gucci with the Vero program, you'll find they are one of the most ardent defenders of their brand and DON'T allow the sales of Gucci on ebay - AT ALL. NO exceptions.

Just thought I'd pass this on to you, as Gucci is often used as a "textbook" example of Vero litigation, and this may help you with being puzzled over ebay's interference in your listings (which will likely continue as long as you try to sell Gucci).

It has NOTHING to do with your listing not being authenic (which I believe they are), it has to do with you NOT being an AUTHORIZED dealer for GUCCI.

Hello there, I did receive an answer from Trust and Safety and it was explained to me very clearly and it made sense, with respects to certain designer denim such as True Religion, Rock and Republic, 7 For All Mankind, unless you can provide sanitized invoices or department store invoices as proof of authenticity, even if you know 100% they are authentic, VERO will remove them and then it's up to you to prove your cause, so I respect their decision and in future will not sell denim without paperwork.

As for Gucci, there are many Powersellers of Gucci on eBay, and none are authorized distributors. As long as you are selling authentic Gucci and you have a legal disclaimer on your listings regarding Gucci, eBay and VERO are fine. If required, you of course should be able to prove where the Gucci came from. My removal had nothing to do with the sales of Gucci but rather with the denim but I do sincerely appreciate your feedback and comments.

I am glad I can put this matter to rest now, eBay is a learning process. 🙂 Thanks.
