Have NOT received my items and numerous reach out to seller - Unresponsive!

Aug 24 2014 I bought and paid for 3 items from a seller with numerous negative and neutral feedback, I was concerned and expressed my concern to the seller, who told me for the volume she sells it's a minor percentage. I told her I wouldn't judge based on someone else's experiences, but on my own transaction with her, she was very nice till the sale was completed. 2 days later she hadn't shipped yet (she lists shipping up to 3 days) so I contacted her and she told me one of the items was defective so it would take a couple of days to replace then she'd ship all 3 items together, that was August 26, she notified Post Office electronically and was issued a tracking number for a package that hasn't shipped, there's no record of acceptance or any movement beyond the notification and a tracking number leading no where.
I've tried contacting her numerous times, she hasn't responded. I'm frustrated out of my mind with her arrogance and attitude and WHY ebay allows her to continue to sell and pull these stunts on unsuspecting buyers, so many rules for sellers and yet someone with this irresponsible and callous attitude keeps going under the radar. I'm not a seller but I think if I did that ebay would pull the plug.
Worse is she stopped communicating which leaves me wondering what next, I even told her that if she doesn't have the items she sold to just refund my money and I'll look elsewhere, but there's been NO COMMUNICATION since August 26, thank God these kind of people are few and far between, they sure make for a terrible transaction and a buyers worst nightmare. It's been 12 days, is that acceptable to ebay to have a seller behaving like this, this seller has 25 negative feedback in 1 year. I'm thinking it's my fault for wanting to trust and give her a chance to redeem herself, she couldn't care less. What do I do?
Terribly frustrated and disappointed ebayer with this particular seller.

Non payers should get unpaid item strikes and be added to block bidders lists. Period.
