I would get on the phone to eBay right away.
They might not do anything especially if you don't have the correct customs disclaimer in your listings but you won't know unless you try.
Keep it brief and to the point, do not pressure the CSR for an instant decision, do mention that you have NOT contacted the buyer about this and don't show any outrage instead just convey your disappointment.
Unfortunately eBay can be sticklers, they do have a policy for this but under normal circumstances they will do nothing unless the listing carries the specific customs statement that is "approved by eBay".
The buyers My World page might be enough to sway them but even if not you should get the report in so it's noted on your file and also (more important perhaps) on the buyers file.
Don't bother emailing, you would be wasting your time. The phone is the only way to get any action.
