If a seller gives you misleading information about an item to make a sell,should this b grounds for return/refund??

Roam Mobility cell phone was a  to buy now item & before buying I had asked seller the question of would this phone work in canada with another carrier.I was told yes & give a list of other network carriers in Canada, all I had to do was buy & switch Sims cards to activate on new network but this seems not to be the case.I tried 2 of the sellers listed networks and both said this phone is not compatiable with their networks.If I had been told no it only works in us with us carriers I would have never purchased item,Sad it was a xmas gift for my daughter ,now theres no phone & no money plus no time to get refund (if possible) & purchase another before christmas.
