PLEASE HELP! SELLER UNCOOPERATIVE!

I bought an item jan 6 2015, was supposed to recieve it january 21 2015..... its now may 3rd 2015, 5 months after the purchase I still did not recieve it. I contacted the seller and he "remembered" that there was a problem with the shipping and that he's going to send another one. His item listing has a table of the "estimated" shipping dates and if over a certain period they refund the money. I told him he didnt need to send send another one and that I would take the refund rather. He still after all this time insists on send it to me and ignores all my refund requests. I opened a case in the resolution center and STILL he ignores my requests. Please help, I dont know what to to!!! I dont know had to make "ebay step in and help" or escalate the case because the seller is obviously not cooperative and we cannot get to an agreement. I cannot find how to ACTUALLY contact ebay and get help, without stepping into those useless redundant "Help & Contact" links.

 

Also he requests that "if i get 2 items that I send him back one (and obviously pay the shipping)", what the heck is this?? I seriously frustrated! I getting frustrated with the "help" ebay is providing and with how this seller can just simply get away with something like this?!

Forget the seller.

He is not going to refund you. There will be no replacement.

 

Go to the Resolution Centre at the bottom of this page and try to open an Item Not Received dispute. If the seller cannot prove delivery (not shipment, delivery) he will be told to refund you. If he doesn't, Paypal will refund you and go after him for their money. Hard.

 

But there are deadlines involved. This used to be 45 days, but in some circumstances this has been extended. If you can't open a Dispute because of deadlines, move on from eBay/Paypal.

 

Instead go to the credit card you really paid with. (PP is just a useful mediator.) Call the 1-800 customer service number and ask about a chargeback. Have all your paperwork, transaction numbers, dates, payments, currency, etc. handy to help her process your refund.

 

And dont' ever accept an offer of a replacement. It is no more likely to arrive than the first shipment.

There should be an 'ask ebay to step in' link in the resolution center case but if it isn't there, it is either a glitch or it doesn't show up after a certain amount of time. The ebay  money back guarantee only covers you for up to 30 days after expected delivery.  Paypal does have a 6 month claim time but you might have made the purchase before they went from 45 days to 6 months. I thought that if your claim was past the time for the MBG then you would routed to Paypal but perhaps it doesn't work that way.


Basically you've waited too long so all I can think of to suggest is to phone ebay and see what they suggest. I don't know of an easy way to get a phone number as  the help pages do seem to loop around and around.

 

It is easier to contact paypal so you might want to try that. Sign into paypal, click on contact us on the bottom of the page. Tell them when you purchased the item and ask if you qualify for their buyer protection plan. If you don't qualify time wise then you might be out of luck.  If you did pay with a credit card through Paypal you can try to file a claim with the credit card company.

I did check numerous times there is no option to "ask Ebay to step in and help".

 

And it is in fact 180 calendar days (6 months) with paypal. Would you recommend me to close the claim with ebay and move on to paypal? because when I try, it says there's already a case open with ebay. 

 

It seems this entire process used to be much simpler a few years ago. Now hopping from one link to the other desperately trying to get some help and only finding it here.

 

There this resolution center thing with ebay where both parties basically send messages to one another "trying to resolve" and other than closing the case, there is no other option that i can find.

I wouldn't close the eBay claim before checking with them.  I've heard that if you close a case on eBay, that PayPal won't allow you to open one there.

 

Here is how to contact eBay by phone:At the top or bottom of this page, click on "Help & Contact", then "Contact eBay" tab.  Choose any topic that seems relevant, such as "Buying" > "How to pay for an item".   Not all topics will provide a link, but many, such as the one above, take you to a screen where you will find, on the right side, 2 choices:  call eBay on a toll-free number, or have them call you.  Follow the prompts.  Have all the relevant information ready.  Be patient - it may take a long time and several customer service reps, before you have all your questions answered satisfactorily.  If you are not getting logical answers, ask to speak to a supervisor.  Call back if needed.  The call centre is in the Phillippines, not all operatives are well trained or familiar with eBay Canada.  If you're lucky, you'll get the call centre in Utah and a native English speaker to assist you - this is more likely if you call during regular business hours, Monday to Friday.

If you paid with a credit card through Paypal you may find it easiest to get a chargeback from the card.

There is a 1-800 customer service number on the card and/or on your last credit card bill. Phone it.
