Seller listed item wrong and now is being difficult!

Hello everyone.  I'm not having fun at the moment.  I recently purchased a antique clock from a seller in the U.S.  I paid $113.00 U.S. for the clock and the total shipping through Global Shipping was $58.00.  This seller  had the clock listed as a Westminster Chime clock.  There were pictures provided of the inner works of the clock but I don't know a lot about clocks and because it was listed as a Westminster Chime clock I  assumed that this was what it was.  The clock was delivered the other day and I unpacked it, sat it on the kitchen table and it has been ticking ever since.  Quite remarkable since it just went through the mail system.  The problem is it is not a Westminster Chime clock but a Eight day two tone chime  clock.  I was specifically looking for the Westminster Chime clock.  I have informed the seller about this and it is his opinion that even though it is not the type of clock he had listed it is still a nice clock and I should be happy with it.  It is a nice looking clock but the wrong chime.  I looked into how much it would cost to ship it back and it would be  around  $100.00.  It is a  large clock.  The seller  says because the clock was shipped through Global Shipping  he will have nothing to do with refunding any of my return shipping costs.  He says he will refund the original cost of the clock which was $113.00 U.S. and $20.00 shipping.  He also mentioned giving me a $25.00 credit towards future purchases from him.    As if I would purchase from him again.   If I were to ship this clock back I would be out more than $133.00 and have no clock either.  It doesn't take a rocket  scientist to figure out that returning  this  clock would be nuts!!   In Can. dollars the clock cost me $167.00 and the $58.00 shipping.  Tack on the return shipping and that' over $300.00.   Any good ideas in dealing with a seller like this?

I just received a message from this seller again who told me I should try and resell the clock on eBay Canada and suggested I should keep my shopping to just eBay Canada to avoid any more problems. What a jerk!!!

You could open an item not as described case - you would also have to go through a Global shipping expert at ebay customer service to get the GSP costs back but I think it is all doable.

It is a nice looking clock but the wrong chime.  I looked into how much it would cost to ship it back and it would be  around  $100.00.

 

You need an Item Not As Described Dispute.

The Resolution Centre is at the bottom of this page.

The seller is responsible for accurate descriptions. This is not actually a GSP case, but make sure the method of shipment is mentioned in your dispute.

Is as simple as can be.

 

The big problem is that while the seller is required to send you a return shipping label, this is not possible when the buyer and seller are in different countries.

There are two possibilities.

He can use Paypal's Send Money service to send you the cost of shipping including Confirmation of Delivery

or

He can refuse the return and you get your refund without returning the clock.

 

And of course there is the negative feedback, trashed Detailed Seller Ratings, burn the house down,see them driven before you and hear the lamentations of their women method. Then you list and resell the unwanted item yourself.

Hi again. The seller has agreed to allow the return of the clock but is only offering a refund of exactly what I paid through Paypal and the $20.00 it cost him to ship it to the Global Shipping Centre. I will still be out the approx. $100.00 to ship it back. I thought of trying to bring the shipping down by packaging it in a smaller box but the box it came in is very good for shipping something like a clock in. It seems the clock may have other issues. It is wound pretty tight and quits ticking after two days. The seller didn't mention this either. I probably will keep it anyhow. I may need to put the $100.00 I would have spent for return shipping to having it fixed instead.

In an Item Not as Described case (which is what you have on your hands), the seller is obligated to pay the cost of return postage (now or later) and Pitney Bowes would refund your Import Charges. If or when you return it, you NEED TRACKING to prove it has gone back to the seller. Do not try to shortchange the packaging material to save on postage because if the item is damaged on return due to your well-intended but misguided actions, the seller would not be required to refund you.

If you are going to be out $100 for shipping it back, why not try reselling it as the seller suggested? It looks like they are going for a bit of money...
