Hello.
I am about to purchase an item that will be a Christmas gift for my son. What happens if there are issues/damages with the item once he opens it on Christmas day? Furthermore, the seller posted that they will not accept returns but who is to say the item is in fact in tact and new as they say.

What's the seller's feedback show? Any negatives? neutrals?
Item-Not-As-Described claims can be made even with a no-returns policy. Time limit for claims on ebay is 30 days after last estimated arrival date.
Inspecting (if possible) before giving the gift is recommended.

It's already mid-November, so mail order parcels are getting more and more unlikely to arrive in time for Christmas (unless you are Ukrainian.) I hope your seller is in Canada or at least North America.
You are protected by the eBay guarantee.
A seller policy of 'no returns' does not mean 'no refunds'. Both eBay and Paypal guarantee that your item will arrive (eventually) and be As Described or you will be refunded.
