Firstly, you have to realize that CP pays insured claims for losses and damages no matter where the goods are lost or damaged and they do not collect from the postal service in the country where the loss or damage occured. This is a reciprocal arrangement that they have amongst the postal services of many countries.
Forget about the service offered in the desitnation country and look at the service employed by you as sender with CP. That is the oly one that matters.
As an example, there is NO such service offered by USPS called Commercial Expedited Parcel, providing faster delivery than regular parcel with insurance, tracking and signatured receipt, yet that is how I send 90% of my goods to US customers through CP.
If USPS doesnt get a signature, or cannot prove where it was delivered and to whom beyond their "word", CP eats the cost and pays me my claim. The same goes for Germany and wherever else you may ship using CP.
It is a recognized cost of CP doing business and offering Global shipping in competition with UPS, Fedex and all the others.
As far as criminal charges, that is up to the local police and/or Postal Authorities. Even though USPS would go after someone in the US for receiving someone else's package and keeping it, CP would be the one out of pocket in reimbursing the sender.
Its like Ontaio's "No Fault" Insurance. Someone hits your car, but your insurance company pays for your damage according to the policy and terms of your insurance, even though it was the other guy's fault.
