What can I do if I don't receive an item but it is too late to make a case?

I purchased to items from a seller and they were both wrong, after waiting a month to receive them. I contacted the seller and they said that they would resend me the correct item, but they were coming from china and they would take about another month. After waiting a month, I went to open a case, and it says that I can't because it has been more than 40 days. It has now been about 6 months, the items are definitely not coming, and the seller has not responded to any of my 20+ messages. Is there anything I can do? or can I at least report the seller somewhere so people know not to buy from them?

After 6 months you can kiss your money Good-Bye.
In the future file your claim within 45 days no matter
what the seller says.

This is a common complaint on these message boards, I am sorry to have to say. The story always
has the same ending:

I hope you have not lost a lot of money. For future reference, get to know the deadlines. You have
45 days in which to file a claim. Should you ever need to go that route (avoiding buying from China
will greatly decrease the odds you'll ever need to open a claim) then file your claim by no later than day 43.
You then have 20 more days to conclude it. Here's ebay's official blurb:

You have only 60 days in which to leave feedback. These sellers aim to delay you past that day 45
when you can no longer open a claim, and past day 60 when you can no longer leave feedback.
So don't let this happen to you again.
If you paid with a credit card, most card companies offer some level of a chargeback option, but after
6 months it is unlikely any of those would help you. It is a very common scam, - a promised replacement
that never arrives. There is nothing outstanding about your seller that way, -- most of them over there are
like that. Just look at their feedback.
There is a lot of the 'buyer beware' about ebay. You've learned a lesson, the same way just about
everyone who buys learns the hard way when they're new to ebay. In future, choose your sellers more
carefully, even if it means you have to spend more money to deal with someone honest and trustworthy.
It's worth it in the end.
