it says 1 case awaits other members' responses  do I still have to close myself or wait for ebay to close its been over 1 week

Yes, close it yourself and you can get your fees back.  You can close it after 4 days, and most sellers count down to the minute. 🙂

You add the person to you blocked list here:

and then you set your preferences to block all people with 2 or more Unpaid strikes by going here:

http://pages.ebay.ca/help/sell/manage_bidders_ov.html#set
