hello i am fairly new to ebay and i ordered an item before Christmas that i have not received yet. i contacted the seller and they said oh dont worrie its on it's way. my time ran out to open a case. now they are not responding to my messages. is there anything i can do?

If you paid by Credit Card you can try them
Not sure if it will work since it's been awhile
they have cutoff dates to file a claim
but it's worth a try
always watch the time when bidding and winning an item
If it gets close to the time to file do it
If it arrives during that time the claim can be easily stopped

thank you for your advise.
i will be filling a claim from now on. they were staying in contact with me and saying dont worie it was sent you should get it soon. but now they wont return any messages. i didnt want to cause anything negative for them. but i have learned my lesson. i was unaware that i could cancel a complaint once i filed it.

Sorry to hear about your purchase. I have learned my lesson as well. I bought something from , an ebay store. They sent me the wrong item and at first they were very nice and said I could return it and they will pay for the postage once they have received it. I spent $50 on postage (to China). I sent them the tracking number and receipt. They stopped corresponding with me. I didn't know about the 45 days to open a case. I was waiting for them to receive my returned item. Then it was too late. I did not get refund for the item I purchased, did not get refund for the postage I paid for the return, and no longer able to open a case or leave a feedback. The seller even stopped my account from buying anything from their store (didn't know they can do that).
Needless to say, lesson learned...

The 'we will send a replacement' scam is relatively new, but is widespread.
As you say, it is very unlikely that anything was sent.
Go to your credit card and ask the customer service rep about a chargeback. Unfortunately, you will not be able to get your postage cost refunded.
