Item is a tool that doesn’t perform as listed in description

So if I buy a tool , say a used drill, that is rated to spin at 1100 rpm, and spins at only 800 rpm, indicating a problem with the motor, how likely am I to get my money back for item not matching description, even though seller lists that returns are not accepted? Thanks.

Yes, open a Not as Described Return for refund. The seller will be obligated to send you Return postage and you send it back with tracking using their label (or funds) and then you get the refund you seek. It's all explained under the terms of the ebay MoneyBack Guarantee which overrides any seller 'no-return' policy. If it didn't, I could sell you a diamond and send you a lump of coal.

Go to your Purchase History and open your Return request from the dropdown menu citing whatever reason is closest to 'not as advertised' and then follow the instructions and/or prompts given to you.

My shop vac manufacturer claims that the motor of this 110 volt vacuum   provides 6 peak horsepower which is basically a lie,there's no way a 110 volt motor can produce more than 1 to 1.5 horsepower.

 

My point is, if you are relying on what the manufacturer claims, you're bound to be disappointed but on the other hand if the seller claims that the drill spins up to 1100 RPM and that's the main reason you bought it, then you need to provide some proof that that claim is false.

Ok, so if I can prove that it doesn’t perform anywhere near the specification due to being used, what is likelyhood of refund?

99 and 44/100 th likely.

 

Annoying as it is to sellers, if a buyer opens a Not As Described dispute, eBay will rarely ask for proof.

EBay will require that the buyer return the item to the seller, and when tracking shows that the seller has it back, the buyer is refunded.

If more than 30 days have passed since delivery, the buyer can instead open the same Dispute with Paypal.

The only difference is that PP always insists that the buyer pay return postage.

 

Most manufacturers will not guarantee their products if they are sold online by anyone but an authorized dealer.

They cannot see how the product was treated after the first sale.

It may be a refurbished return, or used incorrectly by a previous owner, or damaged goods from an insurance claim, or even stolen or counterfeited goods.
