Where did you buy from?
Only sellers in USA and the UK can use ebay's Global Shipping (GSP).
When is the item supposed to arrive?
You can ask for a refund if the last estimated arrival date has passed and you still do not have the package. ebay's protection expires 30 days after the last delivery date (so do not wait too long to open a claim).

I bought from the UK , i think the item arrival date set around april 25 I opened a case on 15.5 and today I asked Ebay to review the case for help.
generaly I should ask for a refund past the estimiated arrival date? isn't it unfair for the seller if i get items + a refund because of a delay ? ebay usually take some time before they give you the option for help.

Depending where the item is coming from I usually wait for a while after the expected arrival date. But it is important that you open an item not received claim within 30 days of the estimated arrival date otherwise you are not convered on ebay.
Was the item shipped with the global shipping system? Did your tracking number start with a UA or UP?
If so, try entering that tracking number at the following url to see if it gives you any more information.

The seller's responsibility for delivery ended when your purchase was accepted at the GSP plant.
Go back to your Dispute, and state clearly that this is a GSP shipment.
GSP has a good insurance policy and usually does not worry about claims of non-delivery. They just pay up.
