Item stuck at ebay illinois shipping hub

URGENT ! I live in Canada and ordered an item in MAY. The item arrived at my local post office but I couldnt get to it in time and it shipped back to the seller. The seller never got it. It has been missing/stuck in the shipping hub since end of May and Ebay is not letting me submit a report for refund. They deemed my case as solved because the tracking number from USPS shows that the item was delivered to me and now I cannot appeal.

 

This is ridiculous, if I did not investigate into this, neither the seller or myself would have ever received the package and my $300 CAD would have been wasted.

I’m assuming you’re referring to an item that was forwarded by the eBay International Shipping (eIS) service. Not all shipments from the US use this service.

The eIS terms and conditions for buyers are linked on the listing page and it’s important for buyers to skim through them for familiarity’s sake in case they need to refer to them again in the event of a problem. It mentions that undeliverable items generally aren’t returned to the seller as the seller gets to keep the monies they received from the sale in most instances where there are post-purchase issues.

It’s also important to keep an eye on deadlines for filing claims for refunds. You only have 30 days from the item’s last estimated date of delivery to file a non-delivery claim through eBay’s Money Back Guarantee program. I’m not sure if you would have been successful going this route, however, as the item’s delivery to your post office may have been considered successful delivery.

Your only options at this point depend on how you made your payment. If you used PayPal, you might be able to file a non-delivery case through them, although I believe they’ve recently revised the time-window for these sorts of cases so you may be out of luck there.

The other option would be to try to dispute the charge through your credit card issuer if your payment method was a credit card. Success isn’t guaranteed here either, however, but banks usually want to hang onto their credit card customers if they’re steady sources of $, so it may be worth trying.  Sorry this happened to you, and good luck.

Two parts of the problem.

When the item is shipped to the hub by the seller, the seller's responsibility for delivery ends.

Responsibility* transfers to the eIS.

And.

EBay considers shipments that are not picked up to be Undeliverable, and neither seller nor eIS would be responsible for any refund.

 

So make sure your chargeback is aimed at the right entity (eBay/eIS) not at the seller.

And hope that your card company is not bothered by you not picking up the shipment.

 

 

 

*This also means that eIS would receive the parcel and make any refunds for Not Delivered,

although eBay does consider that there was an attempted delivery and the shipment was Undeliverable.

The shipment would never be returned to the seller, nor does the seller lose his payment .

My understanding is that eBay is considered the merchant of record in the event of a credit card dispute or chargeback for a sale made on the site, @reallynicestamps. The seller doesn’t have a credit card merchant account for the disputing financial institution to pursue.

If the seller ends up sans funds as the result of a chargeback for a sale they made on eBay, that’s ultimately due to eBay clawing the monies back from the seller as the buyer’s disputing institution recovered the funds from eBay.

If this package was sent through the EIS, it should have gone back to the EIS, not the seller.  That's assuming that it made it back there.

 

You probably  were not able to get a refund because you either waited to long to claim or because the package was not picked up at the post office.  If the package was waiting for pick up there, eBay considers the package as delivered thereofre an item not received claim can not be won.   But as @marnotom! mentioned, you should be able to do a chargeback with your payment provider.
