Need help or advice as to how to handle a shipping problem

I ordered a pair of new boots with box and at last I received this package today (pictures below) as you can see the package and boot box are trashed. I had to spend an hour cleaning the boots, due to the damage , dirt or something got in. When I buy brand new boots with box I would hope the box would not be ruined and the contents dirty. The seller states that this looks like damage from the shippers. I tend to believe him due to the damage to the actual shipping wrap. This is where I  have a dilemma

Sorry I did not clarify the dilemma. Should I go after the buyer as he will not offer any form of compensation for the trouble or do I somehow make a claim against the GSP.

As of right now, there is a thread right underneath this one on the Buyer Central board about a situation very similar to yours. I suggest you read through it and get back to us on this thread if you have further questions.

Thanks I will try. One question, should I go through "Return an item" or " Item not as described? I just do not want to make any errors.

Not As Described.

By the way, the retail display box is not adequate protection for most products. It is designed for the display and some relatively gentle handling.

When the manufacturer shipped the boots to the retailer, that box with a few hundred others was protected by further packaging.

While putting a cardboard box in a bubble envelope should be adequate, it won't withstand very rough handling.

Which seems to be what happened to your item after arriving at the GSP plant (if only because the GSP is smart enough not to accept and take responsiblitly for obviously damaged shipments.

Remember to ask for a GSP specialist.

Thank you very much for all the help. It's usually straight forward in initiating the process, however with the GSP being so poor as of late it confuses the issue, as you really do not want to blame the seller.

There are 2 choices...item not received or a return request.  When you open a return request you choose from a number of reasons and the reason you choose makes it either a buyers remorse return or an item not as described return.  An item that is damaged is obviously not as described and when it is shipping damage and the gsp is used it is usually deemed to be their fault.   Although they may take responsibility in this case, I’m not so sure that it really is their fault unless they discarded some of the protective packaging.  If the seller just shipped them in the original box in a poly bag then IMO the item wasn’t  packaged properly to begin with.

If the gsp do take responsibility then you won’t have to return to get a refund but if it is the sellers responsibility they will have to pay for return shipping.  If you don’t want to return, they could chose to give you a partial refund for your extra work in cleaning the item but they aren’t obligated to do so.
