I know it wasn't empry when sent as I posted it myself. When I 1st started on ebay a few months ago a co-worker told me to make sure I document everything, insure everything, and watch out for scammers.
I'm not sure what to do I took pictures of various stages of packing of the item, including the ebay/paypal shiping label. It was a fairly expensive item(700$+) what are my options and has anyone else had this happen

Here is a thought.
If the package was empty - what did it weigh when you mailed it. If it was relatively heavy there will be a pretty big difference between the shipped weight and an empty package. If that is the case, make sure the buyer is committed to empty. Get him to commit so that at some point he can not come back and claim it was filled with sand and then save all the relevant messages.
Then, I think I would be on the phone to PayPal to inform them and ask for their advice on the matter.
I find that PayPal like being asked for advice of this type and usually they are very helpfull. Let them come to the conclusion that you are being robbed and they will tell you what to do.

Sent it from Ontario Canada to California via Canada post express post with tracking, delivery confirmation and fully insured

The purchase was mailed, and tracking shows it was received.... Buyer says it was received....
The fact that the buyer says he got an empty box... means this is an insurance claim.
The weight of the item is low... based on what OP sells....
Contact Canada Post and start a claim immediately.
Canada Post will follow up with an invnestigation that will involve the USPS... who will deal with the buyer.
This is either a loss in transit... or buyer fraud....
Seller has pictures... of the contents and of the box..... Buyer should also have pictures of the box and a comparison should be made.
Did USPS indicate that someone tampered with the box. indicating a loss in transit

venom

2 - malice, spite
Personally, I do not think venom should ever be used on these discussion boards. Unfortunately, we see too much of it.

I was warned buy a co worker that I should do something like that. he gave me several tips on what I should do when I told him I was starting to sell stuff on ebay. I photograph ALL the items that i ship as I am packing them to have proof that they were adaquitly packaged. I also make sure the shiping lable covers the opening of the box/shipping envelope. If there is smaller boxes/containers on the inside I write on them the address of the buyer and the tracking #.

on your receipt from canada post it should show the weight. if its an empty box it should weigh a lot less. this person is trying to scam you. i suggest you scan the receipt and show it to paypal. use all the evidence u can.

Before involving Paypal or Canada Post, I would inform the buyer that the package was fully insured, and you will be filing an insurance claim. Say that you will expect USPS and Canada post will be investigating, and you want to make sure that the box was indeed empty before you file the claim. Ask if he could check one last time. This gives the buyer an out, and saves you a lot of hassle.
If the buyer still claims the box was empty, file your insurance claim and let Canada Post take care of it.

the buyer has sent me pictures of the package and it is all covered in tape. What I sent was not covered in tape like that. I have opened a case with canada post and they are looking into it. I dont know if the buyer or one of there emplyees opened and removed the items 1st.

I've received packages which were broken open and in some cases the items were no longer there.
I've also received packages with the item still inside but which had broken open and re-taped by the PO.
If I recall correctly they used tape which could be identified as tape from the PO, but that may not always be the case. I don't know for sure.
I other words, what you've described can and does happen.
It sounds like you have it under control.
You insured and you've filed your claim
You'll probably have to refund the buyer first, and then wait for the CPO to refund you which could take 1-3 months (it varies).

If the buyer opens a case and the case get escalated and then is found in the buyer's favour, then you cannot recover FVFs.
If you refund the buyer on you own and then send a request to cancel the transaction you will recover your fees when and if the buyer agrees to the cancellation or enough time has passed with no response from the buyer.
IF you have decided to refund the buyer (have you?) then you simply go to the paypal transaction and refund.

When you sell something, expect the buyer is a scammer and protect yourself properly.
Once you sell something, accept the buyer is telling the truth. Nobody is going to delve into this beyond asking if the box was empty.
Put your claim in, refund the money and move on.
If you don't believe the buyer, just try to get them to hold off on putting a claim in, but at some point, make them put in a claim with ebay. Scam buyers do not like to put in claims as it tags them.
There is one more very real possibility and that is that US customs confiscated the item, which they have every right to do and do.
I have had laptops just disappear, cameras, and more. For one laptop a letter or something was forwarded to UPS that US customs had seized the laptop.
This past xmas, I sent out 10 or so packages on the 28th of Dec. 5 of them did not arrive. 4 just disappeared, and 1 came back to me empty with an apology from USPS. I do believe my items were taken by US customs. They all tracked to the item has arrived in an international destination, then stop. Things have changed since 2001.
The empty package was not from the buyer because they were a newbie and didn't even complain or say anything. I had no idea until it showed up empty and then I refunded the buyer.
