My dear ebayers,
I recently purchased a pen from the U.K and I live in Canada. I recieved a pen which was misrepresented in its discription not to mention missing a part and was non functional. After contacting the seller and expalaning I was left with the option of returning the item or keeping it with a partial refund however if I returnd it I would have to pay for the shipping out of my own pocket. I decided to keep the pencil and after 3 days of thinking and debating wiehter or not to leave a negative feedback I felt it was necessary to do so and be honest. The seller responded to my feedback and I responded back that her statment was untrue. She is now stating that Im being defamatory and making a public statment about her accusing her of lying and is going to take legal action. I would appreciate any comment or support regarding this matter. Thanks

Blowing wind. Bluffing. Tell the seller to proceed with a lawsuit and you will then countersuit accordingly.

I suspect the feedback was removed by eBay. It was not revised by buyer. Earlier this morning the seller showed one feedback revision and it still shows one feedback revision. That seller does not leave feedback upon receipt of payment, only upon receipt of feedback which is why there is no link to the transaction in the original poster's feedback page.

I have found several articles about sellers in the UK suing to have feedback removed.
Apparantly it only costs 10 pounds to file a suit in a British court.
Ans when informed of a law suit eBay removes the feedback rather than defend themselves in court.

Not that I noticed, based on eBay's published policy.
However, in my opinion, if the buyer wanted to leave negative feedback, it would have been preferable to stick to basic: "Item received with broken part. Seller refused refund or to pay for return." (end of story)
Since none of us have seen the correspondance between buyer and seller, it is possible some words may have violated the feedback extortion policy.

Wow I wish it is cheaper in Canada for us to file lawsuits. I had 21 unwarranted negative feedback and eBay had promised me twice to remove them but haven't done since then.
All of them were negatives just because "just because" for no reasons. Two of them were because I didn't offer free shipping, so why the heck did this buyer bid on my items in the first place??? Sheesh!! One buyer got the gall saying I should offer the photos for $5.00 plus FREE shipping! So why bid on them in the first place and eBay has done nothing.
In fact, eBay just love that so they get to "penalize" us with limited and lower search capability, higher fees, etc. What a tragedy that we have to put up with that kind of behavior that eBay allows!

Did you ask the seller if they would pay for your return shipping? I usually ask them and nearly all of them agreed to pay for them. Try it next time. Only a few refused and that is when I left them negative feedback (not unwarranted).

"Lawsuit" may not be exactly what is happening here. I suspect the 10 pounds is for a Small Claims Court case.
Last time I was involved in one of those, the claim cost $25 to file and I represented my company myself as did the other party. Turned out that we were having language difficulties because I was using technical terminology and the client was using different less precise words.
I believe in Ontario Small Claims Court covers transactions up to $5000 in value.
