Seller agreed to refund non-received product by ebay msg, but failed to. It is past 45 days now

Seller agreed to refund the non received item via ebay message a few times. He promised in writing. However, he didn't refund me and now paypal will not resolve the issue due to the 45 day limit. What shall I do? Need help from Ebay!
