What are the rules regarding the sale of computer software/operating systems?

I see a lot of Windows operating systems items for sale without hardware.....has this rule changed?

If it is not the OEM Version but is the Full Retail version unused and still sealed in the box then you can sell it.

This is always a hot topic on the eBay.com computers discussion board if you start a thread there you will get lots of responses.
