I sold a CD to a buyer in Florida on Dec 13/15. On Jan 8/16, buyer emailed me stating he had not yet received the CD. I asked him to give it a few more days until Jan 16 because of all the Christmas mail. I emailed him a couple of times during that time period to check if he had received it. On Jan 17 today, he emailed me and stated that he had not yet received it. I went through paypal and refunded him and told him if he does receive it to let me know and I will reinvoice him. Within a few hours of the refund he gives me positive feedback "great condition, thanks". That statement is his standard feedback to everyone.
Now he could have received the CD a long time ago and thought he would tell me he didn't and just get a refund. We are not talking big money here about $17 including shipping.
Or he really didn't get the CD and rather than putting thanks for the refund on my feedback gave the impression that he did receive it and it was in good condition. Standard feedback to everyone.
I think I have already refunded him, whether or not he got the CD. He gave me positive feedback and it cost me $17.00.
What do you think?

he got the item and i would call it theft plain and simple,by the feed back he left you,unfortunate but true ebay dont see it that way but on the other hand i might be inclined to call ebay and run it by them that he left positive fb pretty much saying that the item was received it,they walk amoung us,i have had a couple items not received but it was awhile ago and sometimes you just have to chalk it up to a bad customer,actually lost my top rated seller status just for that reason,they opened a case without contacting me first,which is very underhanded in my opinion

Probably just being nice and gave you a positive because you refunded. If they were actually lying all along I doubt you would have received any feedback.

I was just about to post a similar opinion.
The buyer left you a rote response which indicates that your transaction wasn't singled out for special treatment as a guilty party would have done.

I'll take the positive feedback and move on. Like you said, it's $17, not a big amount. I have had to refund twice last year of similar amount because the buyers said they didn't receive the item. One of them left me a simple thanks, the other one left no feedback. I'll take a positive feedback and no feedback any day than a negative. The buyer left you a generic response and I think that's okay.
It's a cost of doing business, like someone said brick and mortar stores have thefts too, or something broken because it fell off the shelf. Your cookie jar insurance should hopefully covered that $17, as personally I wouldn't waste any more time and effort on this as it can be uglier.

I would also move on as well but, I do wonder how he answered the question on the feedback page - Did you receive your item on time?
