Because I paid the item, I accepted the seller's terms. ebay said I am not eligible for buyer protection of a item I paid 180$ for UPS and the seller finally sent canadapost cost 43.41. So I lost partial refund. Sounds like fraud to me. I even sent a video proving it as the mailman came to the door showing final shipping the seller went with. He the seller pocketed the difference and did not even send me everything that what was in the auction either. So just to let sellers know. Go ahead you will win and be able to keep the money as hidden cost. You are allowed to. Though of course fb will be a -.

Yes I can but that is neither the point nor what I desire. I simply am asking about the shipping. I want to keep the item.

Huh? You make absolutely no sense..it sounds as if..huh?. What do you even mean? Doohickey by exchanging?, "substantially changed"..you put that in like you are quoting what was said..it was not. Your insight is not of any help at all but to simply confuse.

 

The unit has a UK ac end that needs a North American adapter to plug in our ac outlets. He the seller mentions nothing of this And yet shows photos of it on. Capiche?

Ah ebay asked if I wanted a full reimbursement and I said no. Whatever your wording here there was nothing to suggest a "no return" and or that something is "messy". It's very simple but first read the post before you answer because heck you don't get it.

One of the parameters for Significantly Not As Described claims is that the buyer has not changed the item in any way.

The returned item/doohickey must be exactly what was sent.

So if you changed the (unusable) UK plug for an North American compatible plug you, in the words of eBay's policies 'substantially changed' the item.  The quote is from eBay's policies, not anything previously said in these posts.

On the other hand,making  the doohickey usable by adding a removable adaptor would not be a 'substantial change'.

 

FWIW, eBay has refused to allow refunds when used clothing was washed by the buyer because washing is a 'substantial change'. Which most members consider dumb.

 

Also for what it's worth, sellers pay fees on sales and on shipping. The fees on the items sold is lower than the fees on shipping. T he seller paid more in fees by charging you $180 for shipping, than he would have by charging the correct shipping cost  and raising his asking price.

Same price for you, lower costs for the seller.

 

The general comment from experienced eBayers is to look at the entire price of the purchase and not to worry about the breakdown. As the posters here and eBay have said, you agreed to give the seller $X+$180 for the item. You paid, he shipped.

 

The problem you should have addressed, but seem willing to ignore, is that the shipment was short the adaptor that was shown in the listing.

That would have been a Significantly Not As Described dispute that you might have been able to win. Even by a polite reminder to the seller that you expected the adaptor could have corrected the problem quickly and without rancour, without involving eBay.

You did say a lot of other irrelevant stuff so you can't really criticize others if they have confusion.  If it were me I would have filed a NAD so the seller had to pay RETURN SHIPPING and then I would get back all my money and start over.  I hate conflicts almost as much as I hate being ripped off.  

 

For what its worth, it is against ebay policy to overcharge on shipping.  Sellers are not allowed to use a slower service than the one you paid for.  To quote directly from ebay:

Sellers can charge reasonable shipping and handling fees to cover the costs for mailing, packaging, and handling the items that they sell. However, charging excessive fees for shipping violates our excessive shipping charges policy.

 

I think you should do like the other poster said and CALL ebay to appeal because it is easier for them to fob you off in an email.  No one here can get you back any money.
