is a terrible seller?

I have purchased an item and immediately paid for it on Jan 30, 2014 with PayPal from this seller. Now it's May 13, 2014 and I still have not received the item. I email'ed the seller on March 10, 2014, and they said they will send it again, but no item showed up.  I sent another email on May 9, 2014, but now they just ignored me.  I've sent another one on May 12 and still no reply. 

 

Now I cannot leave a negative feedback because it's over the time limit, and I cannot file a dispute to eBay, nor PayPal because it's also over their time limit.  So what do I do in this case?  Do I just suck it up?  Although, the item is very inexpensive so I don't care about the money, however, I just don't think this is right.  It's now leaving a bad taste in my mouth about buying on eBay. Yes there are tons of rules for buyers and sellers alike ... Never wait more then 45days without filing item not received...

 

just know the ins and outs and ebay is ok to shop on but having to know 100 rules if pretty stupid but it is what it is..

 

Call you Credit Card company if that is how you have your paypal set up to take from your Credit Card and tell them you did not receive the item you purchased and the credit card company will do a chargeback and you get your money back...

 

Have all the Transaction info ready with all the details when you call ...

 

you can also call paypal and explain to them what happened and tell them if they do not help you will just do a chargeback and then if your talking to someone who knows something they will do something because a chargeback means paypal loses the money so they will be more inclined to help you .. Don't be rude it's not paypals fault ..

This is a recent widespread scam from mostly Asian sellers, who count on buyers believing that

a) the mail takes a long time

b) stuff gets lost in the mail and

c) they sent something in the first place and will actually send something in replacement.

 

a) While surface mail does take a long time, Air Mail is very fast. Less than 14 days from China to your doorstep.

b) Not really especially considering the number of parcels winging around the world. In over 30 years in mail order I doubt the international postal system has lost more than a dozen parcels out of 10s of thousands.

c) They lied.

 

Go for the credit card chargeback.

If the seller left you feedback, you can add a Response indefinitely. The most effective Responses are calm and factual. "No item. No replacement. No refund."

Thanks. The seller didn't leave a feedback. May be that's why, so that I can't leave a feedback to them neither.

For your future reference, have a look at the following link that tells you what to do when an item

does not arrive:

You have a low feedback score and that makes you vulnerable to scammers who will not send

the item, knowing you are unfamiliar with the system.

Never again let that Day 45 pass you by, and if you do not have either your money or your item

in your hands by no later than day 43, start a claim. 

You do not not need to have the process concluded by then, just started.

Hello eshopper1234,

We are in the same boat, the seller promised me to resend by fast mail when I didn't receive it after 5 weeks. Seller ask me to wait patience as it might take longer to reach us, now it's more than 2 months, no parcels showing up still (of course now I knew that seller actually didn't resend the item, just fooling me to wait until the 45 days passed and we can't give negative feedback), contacted seller for refund, this time selling claimed that she was going to refund me but since it's passed 2 months and my paypal account's frozen. When I contacted paypal to see if that is true, paypal said seller can do it manually through my email address. Paypal also showed me how to sent a invoice request money back from seller, but she wouldn't response to me. So all those are BS from sellers. I learned my lesson, never accept any replacement in the future. Ask for refund no more than 5 weeks if product not being delivery. Now I have to file a charge back from my credit card company, they told me that I have up to 90 days to file a charge back. I'm just within the time frame and I  got my money back. Good luck to you! We all learn a lesson.

Just to be pedantic:

You have up to 60 days to leave Feedback. The most effective fb is calm and factual.

At the same time you can leave Detailed Seller Ratings. The normal rating is 5. The lowest rating is ONE. If a seller's ratings drop below 4.3 his ability to list and sell are severely restricted.

 

A Response is different.

 

Responses have no deadlines. You can Respond to your own feedback or to the seller's. Again the most effective Responses are calm and factual.

 

You can leave feedback (within 60 days) whether the seller has left any or not.

You can only add a Response to existing feedback.

HI reallynicestamps,

Thanks for your advise, you are saying to leave a feedback within 60 days even if you haven't receive it yet,( in my case, since the seller insist to resend from China of course, instead of refunding my money), then if the item is not arrived after the 60 days, we can add a respond to the existing feedback? I always wait until I got the products before leaving feedback, but most of the time it's too late.

NO, I don't think that stamps is saying to leave feedback before you know the outcome of the transaction.

File a Dispute if you haven't recieved the item by Day 40-- Day 43 at the latest.

This holds the resolution process open for another 20 days.

File the feedback after the dispute is resolved or Day 59 of 60 if there is no resolution (item or cash) in sight.
