We know you might have questions regarding the email you recently received about eBay Canada collecting Canada Sales Tax (GST/HST/QST/ PST) on behalf of our sellers. we all might share the sentiment but its not a question she can answer.  Ebay only follows CRA directives on matters like this, they are compliant to what the Canadian Govt says it has to do.  This question/comment is more appropriate for an accountant, a tax lawyer, an MP, or the Minister of Finance directly (I wrote one once, and while he took 6 months to respond, he did respond, and quite at length too).   She or ebay cant answer that question.  

 

As it stands from my own accountant, they got this dropped on them around tax time and no one there knew anything apart from rumours and I still havent heard back from mine as she was going on a fact finding expedition and would contact me once they got some concrete information.  God knows when that will be, its not going to be an issue until tax time next year anyways.  Really, for those who make over the threshold, it affects us in a number of ways that really only concern who we hire to do our taxes.  Folks under the threshold I would recommend calling an accountant later on in the year and asking the following questions, off the top of my head:

- this tax is being collected due to a CRA directive and I make under the 30,000 threshold.  How can this happen? (they can explain it to you)

-does it mean I have to remit tax as well from Jan 1 to June 30? (probably not, but when it comes to the CRA and their plans, you never want to make assumptions about their courses of action). If the answer is yes (lets hope not) you will not only have to calculate it but be out of pocket for the entire amount as it will have to be remitted (plus the filing fee if you dont do it yourself, my accountant charges $150 to file GST), so its best to have some savings lying around to cover this amount just in case (Id say around $1000 to be on the safe side).

-this very well means you may be able to claim input tax credits towards reducing the amount of GST you paid (or, more accurately, was paid for you by ebay), which may entitle you to a rebate on the amount ebay remitted on your behalf.  In case this happens EVERYONE in this boat needs to save ALL their receipts starting July 1 for EVERYTHING they spend money on related to their business (buying inventory, paying for shipping, buying shipping supplies, gas to drive yourself to the Post Office, etc etc) as every single cent of GST you pay for any service related to what you sell here enables you to a cent for cent writedown on the GST amount collected ( say GST as here in Alberta we have no HST or PST).  Example: if $600 in total tax was remitted on your behalf, and you paid a total of $120 in GST for all your business related expenses, you theoretically would be entitled to a rebate of $120 as you would only owe $480 in tax.  I say this in theory as CRA/Govt of Canada have created a giant can of worms by doing this mid year and collecting on behalf of sellers who previously by law did not have to collect the revenue.  So, this is why speaking with an accountant later on in the year to clarify how this is going to affect your 2023 taxes is paramount.  There's no sense doing it now, as from my understanding at this point in time, accountants dont even understand how this is going to affect them or us yet.

Can you follow up with this issue with your tax team regarding potentially not collecting sales taxes for Canadian sellers with items with a location outside Canada? I tried calling and talking with a couple of phone agents and they seem to only provide a generic scripted response that doesn't seem to address this issue, or they don't seem to understand any of the changes that occured for the Canadian tax changes as they are probably located in another country. Thanks!

"The same issue is happening with cross provincial sales, one of my purchasers in Quebec, was charged QST on top of the GST, which is correctly charged. "

Tax on Bullion is a known issue in the roll out, we are working with our third party systems provider to correct this. Tax on fees for seller is on total transaction price.

We don't need the GST number on the invoices. The numbers for eBay Canada Ltd. are online in the User Agreement in the Fees and Taxes section: eBay.ca User Agreement | eBay. Technically they don’t have to be in an invoice if they’re in other supporting documentation, such as a contract. (They're also included in the Billing Agent Authorization).

Or just include it on the invoice sent with item. Easy peasy!! Like sellers were doing it in the past.

"In Canada, taxes and certain prescribed information should be indicated on invoices, receipts, written agreements or other supporting documentation for the sale, in order for purchasers to validly support their claims for input tax credits.  

 

eBay provides sales receipts/invoices that charge the taxes and contain certain prescribed information (such as descriptions of the products purchased), and our tax registration numbers are in the User Agreement on our website. 

 

As of July 1, 2022, eBay charges and collects the sales taxes on sales in Canada, so it is eBay's name and tax registration numbers that are required to support the input tax credits for purchasers."

Hello Devon,

 

Thanks for the explanation. For the sellers that were collecting tax in the past they were including that information on their packing slips. Now that eBay is looking after this step will eBay be adding to ALL in house packing slips? That should be the how this needs to be handled vs having each seller needing to manually fix/update each packing slip.

 

Additionally the packslip should show the rate of taxation based on an orders destination. Canada and USA. That is standard practice with ALL B & M stores and other online businesses.

I need to fill out an invoice for client`s payment.

The invoice has a field - taxes

Do I have to indicate any taxes in this invoce?

If so, what kind?

You are still based in the USA, shipping to Canada?

This is a bit of a mess, isn't it?  It appears eBay didn't really think this policy through and applied it wholesale to all sellers and items without regard to tax laws in the individual provinces and country-wide.

For example, I am a private seller and just made a sale to a private buyer.  No businesses were involved.  And yet the buyer was charged GST for the sale?  Why? 

And for all the small suppliers who meet the exemption under CRA (https://www.canada.ca/en/revenue-agency/services/tax/businesses/topics/gst-hst-businesses/when-regis...), what is to become of them?

eBay is now required by law to collect gst/hst/pst/qst from buyers when both buyers and sellers are in Canada.

As @pjcdn2005 noted, this isn't so much policy as it's a procedure that's based on a new CRA requirement for sales on online marketplaces. It's all about the venue, not the seller, although some online marketplaces are allowing sellers already GST/HST registered with CRA to continue collecting and remitting the tax themselves.

You might want to take this up with your MP or the Ministry of Finance.

I have a business in Ontario that is HST-registered.

I understand that eBay is considered my agent with respect to HST collection, i filled up the form (GST506E)  that Ebay asked for, because Ebay collects the HST on my company's behalf.

My question is, what does eBay do with the money?

Does eBay remit it to the CRA, crediting the seller's HST account automatically? If so, how long until the remittance is reflected in my HST account? OR

Do they remit on their own behalf? OR

Do they issue a voucher to seller to remit the HST? 

Can anybody confirm if their HST account has received a credit for the remittance from Ebay?

Is your business registered to collect and remit GST already?

If not, don't try it.

Revenue Canada gets annoyed about that.
