Buyer claims chargeback after he agreed for transaction

Hi,


 


I've sell 2 hockey e-tickets April 28th, 2013 to a guy.  Before and even after payment has been made, he asked me many questions to know if tickets were authentic, if he could have the proof of purchase that I bought the tickets...  Since it was playoffs game and game was close to the selling date, I asked him if he minds if I send him E-tickets by email so he could get it faster because in one of those email he sent me, he told me that he was unable to make it to the game so he would try to sell them or give them to some clients in his business.  His tickets were near mine, but the night of the game, nobody showed up.  So, I told myself, well, he could not make it to the game and he did not sell or give them to nobody.  More than a month later, he  called his credit card company to claim a chargeback from Paypal because he did not authorize this transaction !!!! I was shocked !  I exchange more than 20 emails with him and always answer fast.  He told me I had a good feedback and he had confidence in me for the tickets but was scared about scam with Montreal Canadiens tickets.  Anyway, after my shock period has passed, I responded quickly to chargeback as my tickets worth each 271$ so 2 tickets is 542$ but when he bought it, he got them for almost 200$ less at 355$ !  He told me it was a great deal. So, I've sent all emails I have exchange with him and proof that I've sent him the tickets by email and my proof of purchase of those tickets.  Do I have to send also the emails he exchanged with me on Ebay.  I have them all ?  Anything else I can send ?  I lost money with that transaction and now I will loose all ...  What can I add more to have it non-chargeback !!! I was honest I told him everything and he asked me a lot of questions.  Does all the emails will give back my money ( the 355$ are on hold in my account !).  He told me many times that he asked a lot of question because he wanted to be sure not to be robbed with those tickets and here we are now, he wants me to pay the tickets he was unable to use or sell ... It is not my problem !  Can I do more... I'm desperate !!!

Most important of course is that items digitally delivered are not covered by any type of Seller Protection.

Aside from e-Tickets (which I really can't understand anyone sending digitally due to their value and irreplaceable nature), I can't see why Seller Protection would be needed for digital items that can be easily reproduced and re-sent (or shipped if absolutely necessary) if a buyer claims INR  or "damaged" electronically. 


 


Returns on such items are another matter, and I still don't know what the best option is in that regard. "No returns" would seem logical, but there will be buyers who will want money back if they aren't satisfied with the product.  Perhaps show a 'dummy' 14-day return policy, and be prepared to refund immediately if the situation arises?

1) buyer purchases item and pays for it


 


2) seller sends electronically


 


3) buyer claims non-receipt and makes claim with PayPal


 


4) since seller cannot prove receipt by buyer, PayPal finds in favour of the buyer and money is refunded to buyer and charged to seller's PayPal account


 


Keep in mind PayPal does not offer sellers the option to send it again!  There is NO protection for sellers sending "stuff" (whatever it is) electronically.

On the other hand, PayPal Buyer Protection policy does not protect buyers for items purchased to be digitally delivered :

So one has to walk the fine line between something purchased to be delivered physically but delivered electronically and something purchased specifically with degital delivery.

The digital items that actually sell here  in any number aren't items that can be reproduced.  No one is buying a classified ad on ebay to try and sell a file of their self composed music. Dex might still be trying to sell his drop shipping ebook but no one is buying stuff like that


 


Its your one time use items that have value, tickets, virtual game items, gift card like codes, bitcoin that are lost once the buyer uses them.  All the buyer has to do is tell his cc he didn't get it, use a stolen cc, or claim he didnt authorize the payment  and the seller loses as paypal wont take the hit as they would with proof of delivery or in some cases proof of shipment.


 


For the most part ebay doesm't go out of its way to remove the listings that are banned items and obviously digital listed as normal listings. Lots and lots are sold. As least someone scammed with those can retaliate with fb, legit  .com ones listed as classifed don't even have fb

I was unaware of this, although it would seem logical to offer it as an alternative, at least for certain digital products. 


 


I would think in this day of electronic everything that someone could devise a way to confirm receipt of a digitally delivered item that would be acceptable to Paypal -- after all, don't we rely on electronic confirmation of receipt of funds or payment for a purchase?

There used to be quite a healthy market for digital imagery from antique publications and designs in the "Crafts" and "Collectibles" categories -- antique ads, fashion plates, textile and embroidery designs, out-of-print antique craft, needlework and sewing books and manuals, etc., and that many were delivered digitally (I bought a few myself). 


 


I haven't done any research recently to see whether these are still being offered in any number on eBay, but this is the sort of item I was referring to.  These would be easily reproducible at no cost to the seller, and simple to re-send in the event of a buyer claiming non-receipt. 


 


However, given that the 'allowable' way to list such items is in the Classified format, with no FB, I wouldn't be surprised if these sort of items have by and large disappeared.  I've been told the reason for exempting them from FB was due to such items being used for FB padding (i.e. phony multiple FB).  You are probably right that the buyer is actually safer purchasing "illegally" listed digital items so that FB/DSRs can be left.  It's an odd paradox.
