A buyer received a refund even though the tracking number shows delivered. eBay doesn't give me the proper help, and I'm thinking about taking legal actions.

Important to mention that the selling account is under suspension, so I couldn't even express myself in the case. Tried to chat and email with eBay representatives with no success at all.

This may have some effect, particularly if the account has lost many disputes.
If you do not respond with proof of DELIVERY (not shipping, delivery) you will lose a Not Delivered dispute every time.
Do not use Surface Shipping. It takes too long and again if the Delivery is late, you will lose any disputes.
If the buyer cannot afford Air Mail Shipping, he can't afford to buy online.
