So, June 2006, I am sitting in departure at Las Vegas airport.

 

Guy sits next to me and starts telling me how "we" are going to sue eBay and get all our past, present , and future money back.

 

How many have there been since then? A whole lot?

 

I am still waiting for my money.

Those who are selling fakes/counterfeits  and more of the "wrong stuff" better start running..

 

Looking forward to a big cleanup...hopefully.

 

eBay has to consolidate that which they have and is "good"

 

How many listings will disappear....  

 

My guess is  100,000,000  listings and perhaps more.

 

eBay is just too big for its own good.... Look for control... policing  and ultimately reporting of those that sell these items.

 

 

and remember when Louis Vuitton  raked eBay over the coals in court in France.... 

 

 

Definitely more to come....    and perhaps  a close down of certain categories on eBay

The same thing happened on the River.

 

The River responded by basically coming out with extremely restrictive rules.  Any new seller was not allowed to sell DVDs or Blu Rays.  Older sellers had to prove they were buying inventory from this place or that place.  It became a big mess.

 

Won't solve anything, just more sellers are going to leave.

Ebay does need to clean house 

 

As soon as they opened up the ebay door for China, ebay has been flooded with fake & copy items.  Ebay makes millions of $ of the FVF's of the counterfeit items so if it wasn't for companies suing Ebay for this, Ebay would be looking the other way.  Now it is not only China, it's India, Russia and a host of other countries that produce and sell counterfeit goods on ebay.  

 

Ebay has to stop these sellers from listing on .com or .ca.  Buyers from Canada & the US have been buying these items and now they will be reselling them to unsuspecting buyers.  The buyers think that the item is legitimate as they are buying from someone in North America.  

 

I personally would never buy a DVD or anything designer on ebay because there is a good chance it is a counterfeit whether it was from China or not.   A number of years ago I purchase some DVD's from a seller in New York, they were counterfeit, I returned them but was out the return shipping. 

 

This is a big problem for ebay and I am not sure how they will solve it or whether they will do anything.

It will be interesting to see if some of the other Companies will jump on board the law suit because of knock off products of theirs. I think there are a few Companies that do their own policing of their items and in turn report the items to E-Bay, I know from first hand that Zippo Lighters do as I had it happen to me.

Quite often original founders of law firms go on to other pursuits (politics for one!), yet the name is retained by the firm because it had established public recognition -- in those cases founders sometimes retain a partnership share even if they no longer practice.  I expect R. Rex Parris' name is still on the firm banner for this reason.  If he's a mayor, I doubt it's a "spare time" job. 

 

Incidentally, large multi-office law firms like this that specialize in one area of law (here it appears to be motor vehicle accident) quite frequently have a whole section of specialists, or a particular office, focused on a different area of the law.  I've worked in large firms like this myself.  In other words, don't judge a book by its cover.  

 

I expect there is a very high profile commercial lawyer in the ranks whose name will only appear once the matter actually goes to court.  We shouldn't assume this lawsuit is a toothless tiger. 

 

I agree completely with 'cumos' comments.  I think eBay could have been doing much more, for much longer, to better police the site for violators.  Of course, that would have meant fewer fees for eBay...

 

Once again, eBay has shot itself in the foot.

Sellers are allowed to list with stock photos in certain categories.....A fake or counterfeit can be hidden behind a stock photo.

 

There are also situations where a "real"  photo shows the correct item... but a seller ships the counterfeit.....

Something has to be done very quickly.  problem areas have to be dealt with immediately 

 

What we do not want to see  is "guilt by association".... where all sellers are labeled as selling fakes or counterfeits.  ... simply because we all sell on eBay....

I agree with cumos55 I sell mostly in high risk  categories like WW 11 German Military where there are lots of repos not only from China but Eastern Europe also. I am careful who I buy from in Germany trying to avoid the suspect items at cheaper prices and I don't want to be Guilty By Association for selling on E-Bay

E-Bay does not need any more bad publicity as things are slow enough right now any way.

I imagine major retailers must also be having a serious problem with fakes, the difference being that they have direct control over their suppliers and can stop the illegality in its tracks, before it reaches the shelf or online listing.

 

I personally have reported on a number of occasions listings that I knew to be fakes (certain fakes in certain categories have telltale signs), and yet there they are, week after week, continuing to be listed.  This is something that must go on all the time and which, in my view, eBay has never properly addressed. 

 

I agree completely that the other side of the issue of fakes (that is, besides creating upset, dissatisfied customers) is the public optics this will create, i.e. of a corporation that is not taking sufficient, pro-active steps to curb the abuse on its own site.  As you say, we don't need more problems right now!

I can't say, "Good riddance' to all the counterfeit pieces fast enough. I only wish it had not come to this. Lawsuits are bad press.

I was referring to honest sellers leaving.  I would be happy if counterfeiters left.  

 

What will happen is Ebay will overreact and paint everyone with the same brush, except for high volume powersellers that can prove they are buying from legit sources.

The focus with respect to fakes and counterfeits  must be category by category....  

 

The priority has to be categories where  the problem listings....  and then the problem sellers  contribute significantly.

 

There is a possibility that some categories  may be closed... temporarily... or even permanently .

 

There is also a possibility that sellers from certain countries CANNOT list  certain inventory... or even in certain categories
