i have two items that have not been deliveried since the stike ended one from nov and one from early dec -- both customers now have been very patient but now want their money back -- i can see that -- but what about ebay that always dings me every time -- they said they had a policy of not holding you accountantable for those strike caused non deliveries --- but what happens now this late when i refund them will i get dinged for non delivery --??? any answers ?

As it was said, eBay sides with sellers every single time. Especially if there is no available tracking. That's why I never, ever send anything without tracking.

Refund the buyers BEFORE they open the Claim.
This will cancel the transaction without penalty.
In your Message with the refund ask them for their Paypal address so that you can rebill them when their purchase is delivered.

No, do not do this! Fully refunding the buyer without them filing a claim will give you an out of stock defect!

I think femme did a typo, I think she meant before they CLOSE the claim, they being ebay.
PS an alternative to doing the paypal thing is to just list a special only for them ebay item, of which the purchase and process from their perspective is "normal" and what they're used to. (I generally have a more aged customer crowd)

well after contacting both parties -- whom have said they want to get a refund before me getting ahold of them - neither of them has contacted me back directly -- i have on both orders offered to send replacements if they desired -- i only send all items expedited priorty class shipping with trackin of course and have sent them both the tracking numbers- from what i can see both items are stuck somewhere in a warehouse waiting for local delivery - so i guess i amjust at a empass to do anything -- i will wait till ebay gets a hold of me again and lets me know what to do next --is that the right move???

If they filed an "item not received", you should refund if the item has not been received (or there was no tracking).
If you just offered the replacement and are waiting for them to reply, wait for them to tell you they want a replacement, a refund, or file an item not received request against you, that will resolve the impasse and tell you what you need to be doing.
I had an item not received (on a US order without tracking) a day or so ago, and they were claiming they contacted me several times. I pointed out they contact me one time a month ago, and having never heard from them again I assumed they got their item and everything's fine. I'm not going to assume there's a problem if they don't answer me to confirm there is one. They ended up filing an INR request at which point I knew they didn't get their item and wanted a refund, so I refunded. Problem solved.
