It is aso a knowledge thing on the part of the buyer like knowing that seeds/plants and specific plant materials cannot be imported into Canada and those that can, must have the specific certification....
The seller really does not have to take any responsibility in that situation, but the buyer does...it's the buyer that needs to know those specific rules, policies,etc about importing such items into Canada....
and there are always those sellers that will go around the rules just to make the sale(like those sellers from Ch**a that ship seeds labeled as jewelery...

When I first started selling on eBay I tried to list a handcrafted in Kuba(sp intentional) jewelry box. Listing was pulled 15 minutes later. Entirely my fault. Even though I disagree with the issue regarding a ban on this type of item it's in the eBay fine print. Say la vie, que sera sera. Lesson learned.
I do realize that it happens to travellers all the time when they are returning home and finding out that something cannot be legally brought into th country. In those situations it's on them.

Sellers that use EIS should be telling their buyers to open a claim when there is an EIS problem. The problem is that many sellers don't realize that the buyer needs to handle it the same way as if the package had been sent directly to them. The difference is that instead of the claim going to the seller, it will automatically go to Ebay. But some US sellers are oblivious on what to do and couldn't be bothered to ask eBay or on the forums on about what they should do.
I've seen very few examples of items sent to the EIS not being forwarded because they could not be imported into Canada. In most cases the item just appears to be 'lost'. If an item can't be imported, both buyer and seller should be told that and I don't see that happening. So either it is a lack of communication or the items are getting lost, not refused for forwarding.
The EIS seems to be fairly good for not showing a shipping location if the item can't be shipped to that country although I'm sure there are some mistakes.

eBay isn’t pushing eIS as a one-size fits all solution, @lotzofuniquegoodies. Some sellers just aren’t bothering to familiarize themselves with the terms and conditions pertaining to their use of the system.

So I have a package stuck in Glendale Heights since Feb 26 en route to Canada, and no way to find it, what do I do?

Much depends on type of item/value of item/if the adequate customs info was made available at time of shipment,etc. If the date of delivery has not yet come to pass, then it is just a matter of patience. However, that delivery date is important so that you can file an INR claim if needed> if you have not received your item after the last expected delivery date.

It's my experience that it takes about three weeks for a package to move from the USA to Canada. And I've been selling mail order since the 1970s.
What is the last estimated date for delivery that eBay gave you?
Mark that on your calendar and DON'T WATCH TRACKING.
If it has passed, open an Item Not Received dispute.
The seller will not be hurt in any way by this.
If the shipment arrives after you have been refunded by eIS, they don't want it back. You can deal with the (free) purchase as you wish
